- Business Information: Name, business address, phone number, and email address of our Clients (Service Providers).
- End-Customer Data: Names, contact information, and basic details provided during calls handled by our AI voice agents, WhatsApp conversations managed by our automation systems, or data processed through n8n workflows.
- Audio Recordings: Calls processed by our AI voice agents may be recorded for quality assurance, training, and service improvement purposes.
- Chat Transcripts: WhatsApp and other messaging conversations processed by our automation systems may be stored for quality assurance and system optimization.
- Workflow Data: Data processed through n8n workflows, including information transmitted between integrated applications and services, is processed according to the Client's configured automation logic.
- Usage Data: We collect technical data about how you interact with our website and services, including IP addresses, browser type, pages visited, and interaction patterns.
2 Call Recording & Consent
By using our services, Client acknowledges and agrees that:
- All incoming calls to the AI Voice Agent may be recorded.
- SocialVik does not provide legal advice regarding call recording compliance and does not monitor Client compliance with applicable consent laws.
- Client is responsible for ensuring compliance with their local call recording laws (e.g., "One-Party" vs. "Two-Party" consent states).
- We recommend Client include a pre-recorded disclosure on their phone line (e.g., "Calls may be recorded for quality assurance") before forwarding calls to our system.
3 WhatsApp Data Handling
By using our WhatsApp automation services, Client acknowledges that:
- WhatsApp conversation data is processed through the WhatsApp Business API and stored on secure servers.
- Message content, contact details, and interaction history are stored for the purpose of automation functionality and service improvement.
- Client is responsible for obtaining appropriate consent from their end-customers for automated messaging, in compliance with applicable data protection regulations (e.g., GDPR, CCPA, TCPA).
- SocialVik does not use end-customer WhatsApp data for any purpose other than delivering the contracted automation service.
4 How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information:
- To present our Services to you.
- To fulfill the purpose for which you provide it (e.g., capturing appointment requests, routing messages to the business, executing workflow automations).
- To improve system performance and reliability using anonymized data only.
- To notify you about changes to our Website or any products or services we offer.
- To provide analytics and reporting to Clients about their automation system performance.
5 Data Storage & Security
Our services are built on Google Cloud Platform, utilizing industry-standard encryption for data at rest and in transit. While we implement safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.
Data Retention
We retain Client and end-customer data for the duration of the active service agreement plus 90 days after termination, after which data is permanently deleted unless alternative retention arrangements have been agreed upon in writing.
Data Location
All production data is stored on Google Cloud servers located in the United States (Iowa region).
6 Disclosure of Your Information
We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you (trusted third-party infrastructure, analytics, or payment providers), so long as those parties agree to keep this information confidential.
Third-Party Services
Our automation systems may interact with third-party services (CRMs, calendars, communication platforms) as configured by the Client. Data shared with these services is governed by their respective privacy policies, and SocialVik is not responsible for the data practices of third-party platforms.
7 Agency Partner & White-Label Data
For agency partners using our white-label services:
- SocialVik acts as a data processor on behalf of the agency partner (data controller).
- End-client data is accessible to both the agency partner and SocialVik for the purpose of delivering and maintaining the automation service.
- Agency partners are responsible for maintaining their own privacy policies that disclose the use of third-party automation infrastructure.
